Rules on digital signatures for official usage were released by the government on June 25, 2024. In order to ensure compliance with current legislation on digital signatures and services, the Decree only controls the contents of specialized digital signature authentication services for public officials, as indicated in Clause 5, Article 24 of the Law on Electronic Transactions 2023. A public-use digital signature authentication service that has been updated and adjusted as needed to comply with current regulations.

The Decree outlines the broadening of the scope of application in order to comply with the 2023 Law on Electronic Transactions. These include: State agencies and their affiliated organizations; political and socio-political organizations; public business units; cadres; civil servants; public employees; and other agencies, organizations, and individuals that are connected to the provision.

As per the legal provisions, the Decree governs the exchange of papers requiring authentication for digitally signed official tasks between agencies and organizations that provide specialized services for digital signature authentication and direct management agencies. Consequently, it is not specified in the Decree that it is appropriate to issue digital signature certificates based on subscriber authority. Furthermore, as part of its implementation, the Decree eliminates six types of administrative papers, including those that ask for the reissue of digital signature certificates for subscribers and competent individuals.

The decree has added to the present practical criteria for specialized digital signature certificates for the issue of public service certificates and the electronic chip check of identification cards and passports. With regard to offering specialist digital signature authentication services for official usage, this digital signature certificate has a particular validity time and procedure. Simultaneously, the Decree clarifies several novel notions, including CSCA, DS, IS, CVCA, and DVCA, which are employed in specialized digital signature verification services for public service issuance and passport and identity card verification.

It also specifies in great detail the procedures for generating digital signatures intended for public use, verifying digital signatures intended for official use, and Examine whether the digital signature certificate for official use's authentication link is legitimate. In Chapter IV of Decree No. 68/2024/ND-CP, check the digital signatures expressly for public service use.

The current Regulations issued under Decision No. 2140/QD-BTC dated December 21, 2020 will be replaced by digital signatures and digital signature certificates issued by the Department of Financial Informatics and Statistics - Ministry of Finance. This will allow the Ministry of Finance and other units under the Ministry to comply with the legal requirements regarding official digital signatures.
